No, I Don't Normally Post This Late...

...but I just can't wait until the morning for this:
West Midlands officers later arrested the couple on suspicion of manslaughter. They are currently on bail while detectives continue an investigation into the death.
West Midlands police again?

Yeah, it'd pretty much have to be, wouldn't it?

    I can only imagine what someone who loses a child would go through under any circumstances. That a frail, elderly couple should be subjected to THIS?

    None of those swarm of stasi had the slightest bit of sense or human decency ... frankly I think we would be better of with the terrorists in charge than this lot.

  4. There can be such a thing as the police being over-influenced by the attending medics, who may make assumptions about the care based on how awful the body looked.

    The way it has to be decided is that it goes before a jury who decide if the parents owed a duty of care and failed to exercise it such that it reaches the level of gross negligence manslaughter.

    The method of trying this was set in 1977 in a dodgy case where a blind old man and his middle-aged girlfriend/housekeeper took in his elderly sister.

    She was anorexic with various other mental illnesses and the disease caught up with her. In 1977 it was treated foolishly as if either Stone or Dobinson could have done anything to make poor mad Fanny eat, wash etc.

    Stone and Dobinson were found liable for her death as they had assumed a responsibility to her by taking her in. They failed to look after her and ensure she got the medical help she needed.

    The jury was plain wrong. The only thing they could have done was have her sectioned and then let the medics force feed her - which is pretty much the case today. (The units are better at intervening before it reaches that stage, but it still can).

    There are very few of these cases because it is understood how little you can do when faced with OCD. You might just as well arrest the spouse of every dead alcoholic for 'failing to stop them drinking'.

    I'd like to be amazed at the CPS taking more than five mintues to check the medical records and assure the elderly couple that they will not face charges. Unfortunately the CPS do not inspire much faith.

    Using that you should arrest the staff of hospitals for failing their responsiblity. After all a lot of people die in hospitals.Makes you think.

    I look forward to the next time some toddler turns up dead from malnutrition in the local SS 'care', and the inevitable 30 cops turning up to slap the cuffs on every SS worker that ever handled the case file.
