I Thought It Was Up To The CPS To Charge..?

A drunken yob with more than 25 convictions narrowly dodged a prison sentence after assaulting two policeman and a doctor in St Helier Hospital.
Wha..?
Warren Abel, from Purley Way, Croydon, attacked the three men as they were trying to give him treatment at the hospital on May 18.

The 23-year-old told Croydon magistrates' he had drunk 16 pints of lager and taken dozens of diazepam tablets.

After kicking out at the two policeman Abel then spat at one officer before racially abusing the other.
Well, he's (finally) in for a long stretch, I assume?
Fortunately for Chelsea fan Abel, the doctor dropped the charges.
Wait, what..?

Never mind 'why' (admittedly, a damned good question!), how..? I didn't think it was up to an individual to 'press charges' over here..?
Magistrates told the defendant, who admitted two charges of assault and one of racial abuse: "These are three offences connected with your appalling behaviour are sufficiently serious to merit a custodial sentence."
SO GIVE HIM ONE, FFS..!!

  5. "Pressing charges" is from American films.

    Members of the public or organisations may make a complaint or allegation which will be investigated by the police. Once evidence has been gathered that evidence will be presented to the Crown Prosecution Service, who will, hopefully, authorise a charge. The police will then charge the suspect with an offence.
    The original member of the public/complainant/victim/loser may, at any time, with draw their complaint.
    With no "victim" to the assault willing to give evidence, it is very difficult to continue with that charge (issues of competance and compellability).
    The big exception to this is domestic assaults (in theory).
    Pressing charges and dropping charges is for the TV.

  6. Regardless of his "Previous", I believe there to be extenuating circumstances.

    A few years ago whilst going through a bit of a stress related rough patch. I was prescribed by the Doc Diazepam. I stopped taking them as after a couple of beers (and we're talking a couple not a skinful) I was wanting to fight everybody.

    Stopped taking the things and back to my normal peaceable self.

    When chavs lash out in hospital at people trying to help them (usually from self-inflicted alcohol and drug excesses) I really think there is an answer.

    Put them in a sealed box and let them heal themselves.

    If on opening it is found they've died, oh well... so it goes.

    Yes you're probably right. I get Pathological on that 'weed' stuff you crazy kids smoke these days...doesn't make me 'mellow' at all, just psychotic.

    It's a failing of the Brit Justice system that 'intoxication' doesn't decrease the seriousness of the offence but rather,so WOAR (who knows her 'shtick'), INCREASES the severity of the offence.

    Other, more civilized, countries around us do it better.

    In Germany (unless they've changed the law in the last few years) Stabby Mc Chav would not be found guilty of assault but of 'Committing a Crime While Totally Off His Head' which tends to carry probation rather than jail time...even for attempted murder (as I know from personal experience).

  9. Well the phantom flan flinger, Jonnie Marbles got convicted of assault when Rupert Murdoch said he didn't want to press charges.

    Absolutely awesome how much power that man has got eh? Shouldn't be allowed!

    Not according to the police blogs. The CPS seem to think it's just part of their job and they should put up with it... :/

  12. St Helier is in the Channel Islands, why would they want the expense of jailing this yob. He , despite being British , will not be allowed back in.
    There are many anomolies between the UK and the Channel Islands but mostly things are organised for the benefit of their wealthy residents. Why dont you look into this?
