We’ve Found A Hand That Beats ‘Gay’* In Victimhood Poker!

A drunken thug who broke a gay man's jaw after an all-day binge has escaped jail.
Eh..? Surely not!
Smith had been drinking at the Bristol Harbour Festival before confronting the man, who was with his partner and a friend, at about 11.30pm on July 30 in Bedminster.

At Bristol Crown Court Smith, of Dowling Road, Hartcliffe, was given a 12-month sentence suspended for two years, for committing grievous bodily harm, although Judge Michael Harington said the offence "richly deserved" imprisonment.
But then, of course, decided not to give it to him.
He said: "You made some vile, revolting homophobic remarks which were quite unforgivable. The offence alone clearly crosses the custody threshold."
So, why not sentence him to jail? Well, believe it or not, the poor wee lamb is ‘vulnerable’ (in the modern meaning of the word):
Mr Nelson also added that Smith, who has a previous record of antisocial offences, had physical and psychological problems. He is not able to read or write very well, has little education, and is unable to complete manual work due to a congenital defect in his hand.

He said: "He has a deep sense of frustration when it comes to employment and a low self-esteem which is why, on occasion he drinks to excess and takes substances. He is an extremely vulnerable young man."
If he’s unable to work, where does he get the money to buy drink and drugs from?

* As well as ‘Muslim’, that is….

Thanks for the link.

Funny how the hand that renders him unfit for manual work seems to function just fine when it comes to breaking the jaw of his undeniably vulnerable victim.

And it's surely only a matter of time before some misguided organisation bankrolls a lawsuit against the media for using the term 'drunken thug' instead of 'vulnerable person with a substance abuse problem'.

He can`t do manual work with his manky hand? but he can throw a mean punch though, and being thick as fuck is now a mitigating circumstance?
FFS whats wrong with our judiciary?

It wasn't a vile assault, it was a CRY FOR HELP from a vulnerable young man, M'Lord.

Sometimes i really wonder how defence briefs keep a straight face.

anyone who does GBH ought to go to jail. Simples.

Because they get paid to keep a straight face and you can get bet drunken thugs are kept well awat from the fashionable wine bars where the briefs stop off for a glass of Pouilly Fume on the way home.

In related news Occupy Vancouver has decamped to the Law Courts in the centre of town. Let's see how long m'learned friends put up with miscreant soap-dodgers on their doorstep. My bet is they'll be ousted with the full wieght of the law before you can say 'injunction'.

Strangely enough IME law students are second only to med students in the 'drunken debauch and violence' stakes.

Maybe not 'thugs' but certainly 'cads'.

Just think a gay, disabled, single parent, black muslim would be untouchable by the law! I'm just so sick of all these groups I no longer have any charity left. I think I'm becoming a nazi, quite sad really.

Couldn't agree more. My point is that you can bet said lawyers don't get to live anywhere near the oxygen thieves they make excuses for.

An amazing recovery. But then, judges and magistrates must see that so often, it's become unremarkable to them...

"Sometimes i really wonder how defence briefs keep a straight face."

The money helps, I'm sure. That and, as dr cromarty points out, the knowledge that they won't have to live anywhere near these scum.

"anyone who does GBH ought to go to jail. Simples."

It should indeed be a no-brainer.

Assault aside, calling people names carries a custody threshold? In a supposedly grown up democracy?

Srsly?
