Magistrates allowed Mr Gaskin to keep the horse after he said the injury was caused by someone tampering with its tether.
Magistrates did not ban him from keeping animals as he has tended horses since he was a child and sells them for a living.
Magistrate will, it seems, believe just about anything...
The 49-year-old, of Alfreton Road, Codnor, was told he must carry out 100 hours of community work and pay £4,077 costs to the RSPCA, who brought the case to court.
He's going to have to sell a
