Some ‘Comfort’!

Ms Smithers was fulfilling her New Year’s resolution, to exercise regularly, when a dog came towards her from an unsecured home. With not even a bark or growl, the dog latched onto Ms Smithers leaving a significant wound in the calf of her right leg, which later required six stitches.

Remaining very calm and standing still, Ms Smithers knew that if she ran she would only antagonise the dog and possibly spike a more violent attack.

When the dog latched onto her leg, Ms Smithers screamed in the hope somebody would hear something and help her.

Sadly, no one immediately heard the cries for help, but a short time later a local man heard her screams and went to help.
Well, I suspect that dog’s bound for a one-way trip to the vets and…

Oh. Wait:
The dog, that both police and council would not confirm the breed of, has been impounded pending full council investigations.

“We were told there was an alleged dog attack and our council ranger responded with the police force and seized the dog under the Companion Animals Act,” Young Shire Council acting general manager Greg Armstrong said.

The owner told us the dog is a comfort dog and at the time of it being impounded was well behaved,” he said.
I really don’t care if it was wagging it’s tail at the time it was collected, what’s of more importance is that it bit a woman (unprovoked) and held on for some minutes!
“Until the matter is fully investigated, I can’t say whether a fine as such will be issued.”

“What can happen is the matter can go to court where legal action can issue a fine or even a destruction order,” he said.

“But it is likely the dog will be returned to the owner,” Mr Armstrong said.
Great! As if the Angry Exile's stamping ground didn’t have enough vicious and dangerous wildlife – but then, maybe that’s why this thing is described as a ‘comfort dog’?

Another advert for a relaxation of gun laws. She should have been able to draw her revolver and shoot the bugger. It would have let go then.

Sometimes I wonder whether your blog is required reading in less reputable chambers; how soon, I wonder, before some optimistic counsel for the defence insists his shaven-headed, tattooed client needs a 'comfprt dog' in the form of a nine-stone rottweiler.

Alleged attack? Surely if the women has teeth marks in her leg the right size and shape of the dog's then there should be no alleged about it. It's rather like saying JFK was allegedly shot in Dallas.

They could say they the dog in 'custody' is the one alleged to have attacked her...

To be fair to the council, I thought the standard rule was that - unless it's an illegal breed - a dog got one chance, and it was only after a second attack that it got put down.

Granted, personally I'd prefer to have the option of Bucko's solution.

I'd hope not! Even the dimmest junior lawyer ought to have learned something by now.

I think that's one of those things everyone believes, but there's no actual basis in law for.
